By accessing or using flito (flito.app), you agree to these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use flito.
flito (“flito”, “we”, “us”) operates the flito service. We may update these Terms at any time by posting an updated version at flito.app/terms. Continued use of flito after an update takes effect constitutes acceptance of the revised Terms. We will display an in-app notice when we make material changes.
You must be at least 18 years old to use flito. By using flito you confirm that you are 18 or older. We reserve the right to terminate any account we reasonably believe belongs to a person under 18.
You may use flito as a guest (no account required to browse) or by creating an account with a display name and optional email address, or by signing in with Google.
You are responsible for keeping your account credentials secure and for all activity under your account. Notify us immediately at privacy@flito.app if you believe your account has been compromised.
One account per person. You may not create accounts on behalf of others or operate automated accounts.
You retain ownership of the photos, text, notes, and other content you submit to flito (“User Content”).
By submitting User Content, you grant flito a worldwide, royalty-free, sublicensable, irrevocable licence to use, store, reproduce, display, distribute, and process your User Content for the purposes of operating flito — including displaying content on object passports, sharing it with other users, and using it as evidence for AI-generated narration.
You represent and warrant that: (a) you own or have the right to submit your User Content; (b) your User Content does not infringe any third-party rights; and (c) your User Content complies with these Terms.
flito uses artificial intelligence to generate story narration for objects based solely on evidence you provide (photos and notes). This AI-generated content (“AI Narratives”) is owned by flito.
AI Narratives are produced only from your submitted evidence. We do not generate content from nothing. Your underlying User Content (photos, notes, chapter text) remains yours under the licence in section 4.
A core part of flito is the object passport — a permanent, append-only record that travels with each object across owners. Every ownership event, chapter, and narrative added to a passport is immutable: it cannot be edited or removed by you or by us.
You acknowledge that content you add to an object passport becomes part of a shared permanent record accessible to all past and future owners of that object, and to the public.
If you close your account or request anonymisation, your personal information within passport entries (name, profile) will be replaced with “Anonymous”, but the factual content of the entries will remain.
You must not use flito to:
We may remove any content or item that we determine, in our sole discretion, violates these Terms or is otherwise harmful to the flito community.
flito is a platform that facilitates the transfer of physical objects between users. flito does not inspect, verify, or guarantee any item listed on the platform. We make no representations about the condition, safety, value, legality, or fitness for purpose of any item.
All swaps and transfers are made directly between users. You swap at your own risk. By participating in a swap, you release flito from any claim arising from the condition or nature of any item you receive.
Nothing in this section limits any rights you may have under the Australian Consumer Law that cannot lawfully be excluded.
flito may allow users to make a cash offer on a listing, or to add an optional cash top-up to a swap request. These features transmit an offer message between users — nothing more.
Nothing in this section limits any rights you may have under the Australian Consumer Law that cannot lawfully be excluded.
flito operates free-entry weekly prize draws at participating café venues (“Draws”). Entry is free. No purchase is necessary. Draws are conducted under the laws of New South Wales, Australia.
Eligibility: Open to Australian residents aged 18 and over, except employees and contractors of flito, their immediate family members, and staff of the participating café venue.
Entry: One entry per person per Draw. Duplicate entries (same email address) are disqualified.
Prizes: Prizes are the physical objects on display at the venue. Prizes are provided as-is (see section 8). Prize values vary; no cash alternative is available.
Winner selection: Winners are selected by random draw from eligible entries at the scheduled close time. Winners are notified by email. If a winner does not claim their prize within 48 hours of notification, we reserve the right to redraw.
Claiming: Winners must return to the café venue and scan the object QR code to complete the handover. This scan constitutes acceptance of the prize and records the ownership transfer on the object's passport.
flito reserves the right to modify, suspend, or cancel a Draw at any time if required by law or in circumstances outside our control.
We may suspend or terminate your account at any time, in our sole discretion, without notice, for any reason — including but not limited to breach of these Terms, illegal activity, or behaviour harmful to the flito community.
We typically suspend an account before terminating it for a first breach to give you an opportunity to remedy it, but we are not obliged to do so in cases of serious or repeated violations.
You have no right to reinstatement. If your account is terminated, you may not re-register without our express written permission.
You may close your account at any time from your account settings (“Go anonymous” or “Delete account”). See our Privacy Policy for what happens to your data.
flito is a platform. We are not a party to any swap, transfer, or interaction between users. We do not mediate or resolve disputes between users. If you have a disagreement with another user about a swap, item, or payment, that is a matter between you and them.
You release flito and its operators from any claims arising from disputes with other users, to the fullest extent permitted by law.
To the fullest extent permitted by law, flito is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of flito — including but not limited to loss of data, loss of profits, damage to reputation, or harm arising from items received in a swap.
Our total liability to you for any claim arising under these Terms will not exceed AUD $100 or the amount you paid us in the 12 months before the claim (whichever is greater).
Nothing in these Terms excludes, restricts, or modifies any right or guarantee you may have under the Australian Consumer Law that cannot lawfully be excluded.
If you have a dispute with flito, please contact us first at privacy@flito.app. We will try to resolve it informally.
If we cannot resolve the dispute within 30 days, either party may refer it to mediation through the Resolution Institute (or a mutually agreed mediator). The cost of mediation will be shared equally unless a mediator orders otherwise.
If mediation fails, disputes will be resolved in the courts of New South Wales, Australia, and both parties submit to the exclusive jurisdiction of those courts.
The flito name, logo, design, and all content we create (including AI Narratives) are owned by flito or licensed to us. Nothing in these Terms transfers any of our intellectual property to you.
You may not use our name, logo, or branding without our prior written consent.
These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the jurisdiction of the courts of New South Wales for any matter not resolved by mediation under section 14.
